These Terms and Conditions of Use (the “Terms of Use” or “Terms”) apply to the Santa Cruz Swing website located at santacruzswingfest.com (the “Site”). The Site is owned and operated by Discowork LLC, doing business as Santa Cruz Swing (“SCS”).
By accessing or using the Site, you agree to these Terms of Use. If you do not agree, do not access or use the Site.
SCS reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time. It is your responsibility to review these Terms periodically. Your continued use of the Site following the posting of changes constitutes acceptance of those changes.
Participation of Minors & Age Restrictions
Minimum Age
Unless otherwise noted for specific youth programs, participants under the age of 18 (“Minors”) must have their registration completed by a parent or legal guardian.
Supervision
Participants under the age of 16 must be accompanied by a parent or legal guardian at all times while on the premises of an SCS event. SCS does not provide childcare or supervision services. Parents and legal guardians are solely responsible for the supervision, safety, and conduct of Minors while attending SCS events.
Age Verification
SCS reserves the right to request government-issued photo identification to verify age. For events held at venues with age restrictions (e.g., 21+ venues), Minors will be denied entry without refund.
Content & Intellectual Property
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, and “look and feel” of such Content, is owned, controlled, or licensed by or to SCS and is protected by applicable intellectual property laws.
SCS grants you a limited, non-exclusive, non-transferable license to access and use the Site and Content solely for your personal, non-commercial use.
Except as expressly provided in these Terms, no part of the Site or Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed for any commercial purpose without SCS’s prior written consent.
Your Use of the Site
You agree not to:
Use any automatic device, program, or methodology (including robots, spiders, or scrapers) to monitor or copy the Site or its Content.
Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site.
Probe, scan, or test the vulnerability of the Site or any connected network.
Circumvent or attempt to circumvent any security or access controls of the Site.
Interfere with the proper working of the Site or any transaction conducted on the Site.
Use the Site for any unlawful purpose or in violation of these Terms.
Code of Conduct & Event Participation
By using this Site to register for events, classes, workshops, or other activities, you agree to abide by the Santa Cruz Swing Code of Conduct.
SCS reserves the right, in its sole discretion, to refuse service, cancel registrations, remove individuals from events, and/or ban individuals from future events who violate the Code of Conduct or any safety or harassment policies.
Participation in dance and movement-based activities involves inherent physical risks. By attending SCS events, you voluntarily assume all such risks to the fullest extent permitted by law.
Media Release (Photography & Video)
By attending events promoted or sold through this Site, you acknowledge that you may be photographed or filmed. You grant SCS the irrevocable right to use your likeness in photographs, video, or other digital media (“Media”) in any and all publications, including web-based publications, without payment or other consideration.
This consent applies to all attendees, including Minors, whose parent or legal guardian consents on their behalf by permitting attendance.
If you have concerns about being photographed or recorded, please notify event staff upon arrival, and SCS will make reasonable efforts to accommodate your request.
Purchases; Other Terms and Conditions
Additional terms and conditions may apply to purchases of event tickets, class passes, or merchandise.
Refund Policy
All sales are final unless otherwise stated in the specific event description. You agree to SCS’s Refund & Pass Transfer policy.
Pricing
SCS reserves the right to change any products or services offered on the Site, or applicable prices, at any time without notice.
Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. SCS DOES NOT WARRANT THAT THE SITE OR ANY CONTENT, SERVICE, OR FEATURE WILL BE ERROR-FREE OR UNINTERRUPTED.
SCS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY LINKED SITES.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS.
If SCS is found liable for any damage or loss, SCS’s total liability shall not exceed the greater of (1) the total fees paid by you to SCS in the six (6) months prior to the event giving rise to the claim, or (2) US $100.00.
Indemnity
You agree to indemnify and hold harmless Discowork LLC (DBA Santa Cruz Swing), its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.
Governing Law; Venue
All matters relating to your access to or use of the Site shall be governed by the laws of the United States and the State of California, without regard to conflict-of-law principles.
You consent to the exclusive jurisdiction and venue of the state and federal courts located in Santa Cruz County, California, and waive any objection to such jurisdiction or venue.
Feedback and Information
Any feedback you provide shall be deemed non-confidential. SCS shall be free to use such feedback for any purpose without restriction or obligation.
